In California, driving a motor vehicle is a privilege. There are several ways that your driver’s license can be suspended including: accumulation of too many points, unpaid tickets, possession of a controlled substance, failure to carry insurance on your vehicle, refusal to submit to a blood-alcohol test, or failure to pay child support.
Having your license suspended or revoked is a very serious matter. Usually, you receive a formal letter from the Department of Motor Vehicles (DMV). Other times, you learn only after you are arrested for it. Either way, we can help get your license back. If you are aware that your driving privileges have been suspended or revoked, do not drive! You can be arrested and taken to jail. However, after you meet with us and we review your case, we will guide through the complex process of having your license reinstated. It is not an easy matter, even for experienced lawyers.
When dealing with driving while license suspended (DWLS), the first issue is whether the driver knew about the suspension. If he or she did not know, then it may be charged as an infraction. If he or she did know, it may be charged as a misdemeanor.
The second issue is why the license was suspended. For example, it is more serious to drive if the license was suspended for driving under the influence (DUI), or habitual traffic offender (HTO) status, then if the driver simply failed to pay a traffic ticket.
The third issue is how many times has the driver been charged with driving while license suspended (DWLS). The fine and other punishment tend to go up depending on prior convictions.
The fourth and final issue is compliance. After getting stopped for driving while license suspended (DWLS) did the driver fix the problem, and reinstate his or her license. Generally, the prosecution and judges are more sympathetic to those that reinstate their license immediately after being charged with driving while license suspended (DWLS).
As former criminal prosecutors, Perlmutter & Pourshalimi have extensive experience with driving while license suspended (DWLS) charges. We can help you fight the charges against you, and may even be able to help you reinstate your license.
