DUI charges range from the simplest misdemeanor first DUI, to serious felony DUI if the DUI involved an injury or the person has prior DUI convictions. Under California law, DUI can be proven in one of two ways: (1) proof that a person was “so impaired that he or she is no longer able to drive a vehicle with the caution of a sober person, using ordinary care, under similar circumstances”; or (2) proof that a person’s BAC was .08% or above. The punishment is the same regardless of which method DUI is proven.
